These Terms and Conditions govern the use of Capital Flow’s services. By submitting a form, registering, or otherwise engaging with Capital Flow, you agree to be bound by these Terms and Conditions.
Capital Flow operates as an affiliate marketing and referral service that connects businesses with third-party funding partners. We do not provide direct lending, credit, or financial services. We pre-screen applications for basic requirements compliance before referring qualified businesses to our approved funding partners. All funding decisions, terms, conditions, and financial obligations are determined solely by the funding partners.
You agree to provide accurate, complete and up-to-date information when submitting applications. Capital Flow performs initial compliance checks to verify that applications meet basic requirements before forwarding them to funding partners. You must notify Capital Flow of any material changes to the information you provided. Meeting our initial requirements does not guarantee approval by funding partners.
Our services are offered to registered businesses in South Africa that meet our lending criteria. Certain entity types (for example sole proprietors, trusts or partnerships) may be ineligible. Eligibility remains subject to Capital Flow’s credit assessment and discretion.
Our referral services are offered to registered businesses in South Africa that meet basic compliance requirements. Certain entity types may be ineligible for referral based on funding partner criteria. Meeting Capital Flow's initial screening does not guarantee approval by funding partners. All final eligibility, credit assessments, and funding decisions remain solely with the funding partners.
To the fullest extent permitted by law, Capital Flow acts solely as an intermediary and referral service. We are not responsible for funding decisions, loan terms, repayment obligations, or any actions taken by funding partners. Capital Flow will not be liable for any indirect, special, incidental or consequential loss or damage arising from funding partner decisions, including any loss of profit, business interruption or loss of goodwill.
Capital Flow complies with the Protection of Personal Information Act, 2013 (POPIA). By submitting your information you acknowledge that your personal and business information will be collected, stored and processed in accordance with POPIA and this agreement. You have rights in relation to your personal information as described in our Privacy Policy.
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts.
All content, trademarks, logos, and intellectual property on our website and in our services remain the property of Capital Flow. You may not reproduce, distribute, or use our intellectual property without written permission.
You agree not to: (a) provide false or misleading information; (b) use our services for any unlawful purpose; (c) attempt to gain unauthorized access to our systems; (d) interfere with the proper functioning of our services; or (e) engage in any fraudulent activity.
Capital Flow does not act as a credit provider. All credit agreements, and obligations are directly between you and the funding partners. Funding partners are responsible for their own compliance with the National Credit Act, 2005 (NCA) and other applicable regulations. Any rights under the NCA, including debt review and pre-agreement disclosures, are matters between you and the individual funding partners.
Either party may terminate this agreement at any time. Capital Flow may suspend or terminate your access to referral services immediately if you breach these terms. Termination does not affect any existing relationships with funding partners or outstanding obligations to them.
If you have a complaint, please contact us at finance@capitalflow.co.za. We will acknowledge your complaint within 3 business days and aim to resolve it within 20 business days. If unsatisfied with our resolution, you may escalate to the relevant ombudsman or regulatory authority.
Capital Flow will not be liable for any failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government actions, or technical failures.
We may update these Terms and Conditions from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
By submitting a form or engaging with Capital Flow you confirm that you have read, understood and agree to these Terms and Conditions, and you consent to the collection, processing and sharing of your information as set out above.
